General sales conditions
The present « General sales conditions » are concluded between.
Aerolithe SARL, which capital stock is 100.000 € and which head office is 6 rue des Plantis, 60800 Fresnoy-le-Luat, registered with the Trade and Commerce Register of Compiègne under the number B410429559, hereinafter referred to as “Aerolithe”, on one hand, and any private or legal person wishing to purchase on the web shop of
www.aerolithe.fr, hereinafter referred to as “the Purchaser”, on the other hand.
The contract
The present general conditions aim to define the contract relations between Aerolithe and the purchaser as well as the sales conditions liable for any purchase made on the commercial website of Aerolithe, by a professional buyer or a private consumer.
The purchase of an item on this website implies that the Purchaser has fully accepted the present Sales Conditions.
These sales conditions shall prevail on any other general conditions or particular conditions not expressly agreed upon by Aerolithe.
Aerolithe reserves all rights to amend its sales conditions at any moment in which case the prevailing sales conditions will be those applicable on the date of the order of the Purchaser.
Products and services
Products and services offered are those published on the website of Aerolithe. These products and services are available in limited stock.
Each product is delivered with a description established by the provider of the product. For some products bearing the mention DF, the purchaser can have access to the documentation of the provider.
The photos of the catalogue are as close to the truth as possible. However, perfect similitude to the product - including the colours – cannot be ensured.
Prices
The prices on the catalogue are in € ex-VAT and VAT incl. prices at the rate of the VAT at the date of the order. Any change in this rate will be applied to the price of the product or the service. Aerolithe reserves the right to change its prices on the catalogue at any time. However the price on the catalogue on the date of the order will be the only applicable to the Purchaser. The indicated prices do not include costs related to the procession, the shipment and the delivery of the order.
Geographical aera
The online sale of products and services on this website is intended for purchase residing in Europe, in the DOM-TOM or in Monaco and for delivery in those geographical areas.
Orders
The Purchaser who wishes to order must
- create an account in which he will give all requested information or give his customer’s account number if any.
- fill in the online order form by giving all references of the ordered product or services
- submit his order after having checked it
- do the payment according to the terms and conditions of the website
- confirm his order and his payment
The confirmation of the order implies that the Purchaser accepts the present sales conditions, recognizes that he as full knowledge of the sales conditions and renounces to claim his own purchase conditions or any other conditions.
All the provided information and the registered confirmation will be regarded as the proof of the transaction. The confirmation will be regarded as the signature and acknowledgment of the transaction. The seller shall send an electronic confirmation of the registered order.
Withdrawal
Purchasers, i.e. private non professional consumers, have the benefit of a withdrawal period of 7 days, starting on the day of the delivery of the order, to return the product (in its original packaging) to the seller for exchange or reimbursement without penalty, except for the return costs.
Payment
Payment is due upon order. Payment can be made by check, wire transfer or bank card. Payments by bank card will be made by the secure payment Cybermut of the Credit Mutuel bank using the SSL protocol (Secure Socket Layer) ensuring that the transmitted information is encrypted and using software ensuring that no third party can take this information while transported on the network.
Upon request a hardcopy of the invoice with the charged VAT shall be sent to the Purchaser.
Delivery
Deliveries will be made exclusively at the address indicated on the purchase order and in the selected geographical area. The Purchaser shall be responsible for the product from the moment it leaves the premises of Aerolithe. In case of damage during the transport, the Purchaser shall file a written report with the transporters upon delivery.
The delivery time is only given as an indication. Should it exceed 30 days starting on the day of the order, the Purchaser shall have the possibility to cancel his order and receive the corresponding reimbursement.
Warranty
All the products delivered by Aerolithe bear the legal warranty as defined in article 1641 and subsequent of the Civil Code. In case of non conformity of a product, it shall be returned to Aerolithe which will take it back, exchange it or reimburse it.
Any claim should be made in writing to the following address and within 30 days: Aerolithe / Cirrus France, Aérodrome le Plessis-Belleville, 60950 Ermenonville, France.
Responsibility
In the process of online sale, Aerolithe shall commit itself to a best endeavour. Aerolithe shall not be liable for any damage due to the use of the internet network such as loss of information, intrusion, viruses, service break-up or any involuntary problem.
Property Rights
All the information on the site of Aerolithe is the exclusive property rights of Aerolithe.
No one is authorised to copy, exploit, transmit, or use, for any reason whatsoever, even if only partly, information of the website, should it be software, visual data or sound data.
Links – simple or hypertext – are strictly forbidden without the written consent of Aerolithe.
Personal data
According to the law of January 6, 1978 the personal data can be used in an automatic treatment. Aerolithe reserves the right to collect information concerning the purchaser - even by using cookies - and to transfer this information to business partners. The purchaser can refuse this data to be disclosed by informing Aerolithe. The users have the right to amend or modify the collected information according to the law of January 6, 1978.
Archives – Proof
Aerolithe shall file the order forms and the invoices on a durable support which will be a trustworthy copy according to article 1348 of the Civil Code.
The computer-generated copy held by Aerolithe shall be regarded by the parties as proof of communication, order, payment and transaction between the parties.
Dispute
The present General Sales conditions are submitted to the French law. In case of dispute, the language used for interpretation shall be the French language and the tribunal shall be that of Senlis, whatever the number of defendants or claim of warranty.
